Terms of Service

By using the PawGuard Hub, PawGuard AI, or accepting a Founder Backer pledge, you agree to these Terms of Service. Please read them carefully. These Terms form a legally binding agreement between you ("you", "the Customer") and PawGuard ("we", "us", "PawGuard").

1. The Services

  • PawGuard Hub — a free booking and operations platform for dog facilities (bookings, payments, customer database, staff scheduling, dog profiles).
  • PawGuard AI — a paid premium intelligence layer adding incident reports, risk dashboards, and Sentinel live monitoring.
  • PawGuard Founder Backer — a one-time pre-launch pledge ($499 AUD) that grants product credit and lifetime founder pricing, governed by the Refund Policy.

2. Eligibility

You must be 18 or older and authorised to enter contracts on behalf of any business you represent. Services are intended for use by Australian businesses (with planned UK / Canada / US / SG / NZ expansion).

3. Acceptable use

You agree to use PawGuard only for lawful purposes. You may not:

  • Upload content you do not have the right to (CCTV footage of premises you do not operate; dog profile data without owner consent)
  • Reverse-engineer, scrape, or attempt to extract our underlying models
  • Use the platform to harass, defame, or unlawfully surveil any individual
  • Resell or sublicense access without written permission

4. Your content

You retain ownership of everything you upload. You grant PawGuard a limited licence to process your content for the purpose of providing the Services. We do not use your CCTV footage to train cross-customer AI models without explicit opt-in.

5. Payments & subscriptions

Paid subscriptions are billed in advance (monthly or annual). You may cancel at any time; cancellation takes effect at the end of the current billing period and no partial refunds are given for unused time except as stated in the Refund Policy. Prices are in AUD and inclusive of GST where applicable.

6. Founder Backer terms

The $499 AUD Founder Backer pledge is subject to a binding refund guarantee: if PawGuard has not launched a live, operational paid-tier of PawGuard AI by 31 December 2026, every backer is refunded in full automatically via the original Stripe charge. See the Refund Policy for details.

7. AI outputs & disclaimers

PawGuard AI outputs are observed behaviour notes, not medical or behavioural diagnoses. All reports require human staff approval before publication. You are responsible for the accuracy of incident reports you approve and share. We make no warranty that AI outputs will be free from error.

8. Liability

To the maximum extent permitted by Australian Consumer Law, our total aggregate liability to you for any claim arising from the Services is limited to the fees paid by you in the 12 months preceding the claim. Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Termination

Either party may terminate at any time with 30 days' written notice. We may suspend access immediately for material breach of these Terms (e.g. unlawful use, non-payment).

10. Governing law

These Terms are governed by the laws of Western Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Perth, Western Australia.

11. Changes

We may update these Terms from time to time. Material changes will be notified by email to the address on file at least 30 days in advance. The current version is always available at pawguard.com.au/pages/terms-of-service.
